Article 1 – Definitions
Contractor: Prestige Stucwerk
Client: any natural or legal person entering into an agreement
Agreement: any arrangement between contractor and client
Services: all plastering and finishing services performed by contractor
Article 2 – Applicability
These terms apply to all quotes, agreements and services of contractor.
Deviations are only valid if confirmed in writing.
Article 3 – Quotes and Agreement
Quotes are non-binding and valid for 14 days.
An agreement is formed once the client agrees.
Quotes are based on information provided by the client.
Inaccuracies may lead to price adjustments.
Article 4 – Execution of Services
Contractor performs services according to professional standards.
Client provides a workable environment: free access, electricity, water and suitable substrate.
Contractor may engage third parties for execution.
Article 5 – Additional Work
Additional work is only performed with client approval.
Additional work is invoiced separately.
Additional work includes extra work not specified in the quote or that becomes necessary during execution.
Article 6 – Prices and Payment
Prices exclude VAT unless stated otherwise.
Payment must be made within 14 days of invoice date.
Late payment puts the client in default and interest and collection costs may be charged.
Contractor may suspend work in case of non-payment.
Article 7 – Liability
Liability is limited to the invoice amount of the assignment.
Contractor is not liable for damage caused by defective substrates, moisture problems, structural faults, subsidence or external influences.
Indirect damage is excluded.
Article 8 – Warranty
Warranty on workmanship according to standards of good work.
Warranty expires in case of moisture problems, leaks, subsidence or improper use.
Color and texture variations are not covered by warranty.
Article 9 – Cancellation
Cancellation is possible up to 48 hours before work begins.
Cancellation within 48 hours may result in costs charged by contractor.
Contractor may cancel due to unforeseen circumstances or incorrect information.
Article 10 – Applicable Law
Dutch law applies to these terms and conditions.
Disputes are preferably resolved through consultation.
If consultation does not provide a solution, the dispute is submitted to the competent court.
